Legal Services – No Surprises with Flat-Fee Prices

Most of the legal services I provide are on a Flat-Fee basis. You will sleep better knowing that you will not be charged more money than we agree for my legal services. After your free consultation, if you decide you want to move forward, you and I will determine the scope of the services you need and the fee for those services.

Under certain circumstances I may provide my legal services on a limited pay-by-the-hour structure. This means that you only pay for the time it takes me to complete the work for you. I do not round up to the nearest tenth of an hour like most attorneys.The only additional costs to you are for filing fees, notary fees, and/or process service. I will discuss with you the expected additional fees or costs that are not included in my attorney fee, so you won’t be surprised.

I accept payment from credit cards, debit cards, check, money order and cash.

By providing efficient, cost-effective legal services and advice, your money is not drained away by runaway legal fees. You remain firmly in control of the legal services you pay for and receive.

Dealing with family legal issues is not a one-size-fits-all approach. Every case is different and every family’s needs are different. Seventy-percent of the family law cases filed in California have one or both parties unrepresented by an attorney. Self-represented parties without professional legal assistance are taking a toll on the court system and on the parties themselves. Not everyone can afford full attorney representation, but most people can afford some good legal help. That is why it is important that we discuss your needs and craft a solution that works effectively for your circumstances.

Family Law Packages

Summary Divorce $795

California family courts have a streamlined process for divorcing couples who separate within 5 years of their wedding date. This summary divorce requires fewer documents and is not as complicated as a regular divorce. It still takes a minimum of 6 months for your divorce to be final. In a California summary divorce you do not have to go to court.

The following must apply in order to qualify for California’s Summary Dissolution:

  1. No children were born or adopted during the marriage.
  2. Wife is not pregnant.
  3. Neither of you: own very much, owe very much, want spousal support from the other, or own real estate.
  4. You agree about how your belongings and debts will be divided once you are no longer married.
  5. At least one of you lived in California for the last 6 months.
  6. At least one of you have lived in the county where filing for divorce for the last 3 months.

This package includes:

Attorney consultation of up to 50 minutes.

Attorney preparation of all documents you need to file with the court to complete a summary dissolution: Joint Petition for Summary Dissolution of Marriage, Property Settlement Agreement, and Request for Judgment, Judge of Dissolution of Marriage, and Notice of Entry of Judgment, Notice of Revocation of Petition for Summary Dissolution.

Not included: Attorney representation in court; Court filing fees ($435 in most counties as of 1/1/2015); Service of process fees (varies from $50-$100; not always required); Notary fees for each spouse’s signature on the Marital Settlement Agreement (typically $20-30 per signature).

Uncontested Divorce without Children $2,000, with Children $2,500.

An uncontested case means you and your spouse or partner agree on everything, you want to stay out of court as much as possible, you want the paperwork to correctly state your agreement and the paperwork is accepted by the court.

Uncontested Divorce may be right for you if you and your spouse do not qualify for a Summary Dissolution/Divorce, but you both agree:

  1. How you want to split up your assets (stuff), debts (bills), pets, your property (real estate, pensions, investments, livestock etc.).
  2. Where the children will live, the time they will spend with each parent and whether either of you will pay the other child support.
  3. Whether either of you will pay spousal support (alimony) to the other and if so, for how long.

This package includes:

Top Divorce Mediation Court Appearances

Contested Divorce – consultation package $350

If you know that you and your spouse do not agree to everything, I will help you build on your agreements to ease the stress and trauma on your family. We will go over a checklist to determine what you agree on and where the differences are. I will then help you develop a strategy to keep the drama to a minimum. Divorce is a very difficult time and often the heat of emotions or painful feelings get out of control causing a divorce war. I help you avoid the war when peaceable solutions are possible, but you may still need a strong advocate for some issues.

In contested divorce cases I will provide you with legal help you need, including:

  • Coaching and advice while you represent yourself.
  • Limited scope of work for a specific task or issue.
  • Full attorney representation where I aggressively represent your interests until your divorce is finalized.

The total legal services fee depends on the complexity of your case and the scope of the work you want me to do. I charge staged flat-fees (fixed fees) which are due thirty-five days BEFORE each stage of the case. You will sleep easy knowing you will not receive a surprisingly large legal bill that you didn’t expect.

DIVORCE MEDIATION PACKAGES

Basic – $2,500

Basic California divorce mediation packages are for people who do not have serious disagreements about child custody, have minimal assets/debts, and no self-employment or business interests that need to be divided. When you and your spouse or partner need some extra help to reach agreement on the details of child custody and support agreement, and to make it legal.

This package includes up to two 60-minute mediation sessions, all phone calls, emails, drafting and 1 revision of the agreement and attachments. Instructions on filing and serving all court documents. Instructions on complying with mandatory financial disclosures. The mediator will file and serve documents.

Not included: You are responsible for filing all documents with the court and keeping your own files. Court filing fees $435 (as of 8/1/2017).

Comprehensive – $3,600

Comprehensive California divorce mediation packages are for when you and your partner have moderate to complex issues regarding the children, division of assets and debts, or trouble communicating with your spouse but you both agree that you want to stay in control of your divorce and you do not want a judge to decide for you.

This package includes up to four 60-minute mediation sessions, preparation and up to 2 revisions of marital settlement agreement and filing of all court required documents, including financial disclosures. I will handle the filings and provide each of you a complete set after the court has filed and approved all documents.

Not included: Court filing fees which are usually $435 (as of 8/1/2017).

DISCLOSURES REQUIRED: Disclosure laws require a FULL DISCLOSURE from each spouse/partner as to assets, debts, and income. This includes separate property as well as community property. The disclosure process requires certain paperwork to be completed by each party and provided to the other party at certain stages in the case. The penalties for failing to comply with the disclosure laws can be SEVERE. The Disclosure process is mandatory; and there is no safe way to avoid complying. This applies to all family law cases.

Attorney Representation in Family Court

Request for Order or Motion $1,000

Trial or Evidentiary Hearing $1,500

The time required for court hearings vary by county court. I must be able to set aside up to an entire day for your matter. You are reserving my time for the entire day even if the hearing itself takes much less time. I also reserve the right to accept more than one client’s matter for the same court on the same date and time, as long as it is customary for an attorney to handle multiple matters on that particular court’s calendar. If I handle multiple matters, I will provide each client with a 10% refund of fees.

Judgment or Marital Settlement Agreement Review $500: If your spouse has provided you with a judgment and/or marital settlement agreement that your spouse wants you to sign off, it is in your best interests to have an attorney go over it with you. You need to know whether you are giving up important legal rights and make sure you understand the consequences of what you are signing. I will review the terms with you, advise you on any other options that may benefit you more, and give you peace of mind that you are doing what is best for you.

Support Calculations with Reports: I provide affordable Child Support and Spousal Support calculations, so you will have the peace of mind knowing the likely support amount the judge will consider, before you get to court. The report will also give you an indication of what your “net income” will be after taxes and support, so you can make a realistic household budget during your divorce. Remember, these calculations are only as good as the information provided. If you find out additional or different information, you will need a recalculation.  $100 first calculation with report. $50 per additional calculation using different facts or monetary amounts.
